BAC Language Forces States to Adopt .08 Mandate

Although the penalties will not take effect until fiscal year 2004, the National Restaurant Association is disappointed that President Clinton signed the Transportation spending bill, which includes language forcing states to implement a .08 blood alco-hol concentration (BAC) per se law or lose highway funds.

More than 30 states will be forced to adopt the lower standard despite the fact that their legislatures have previously rejected .08 laws because there is no conclusive evidence that they directly save lives.

The NRA will continue to explore all options to further delay or repeal the punitive .08 federal mandate and to produce a truly effective solution to the tragedy of drunk driving.
